1. Definitions

1.1 For merchandise we use the following descriptions:

- Never worn with tag - merchandise was never worn and has original retail tag/tags, this can be on shoes or bag

- Never worn - merchandise can be without a tag but shows it has never been worn and has no visible defects, pulls, scratches, or snags

- Very good condition - this is visibly second hand merchandise which has been only slightly used and has been very well maintained, there can be light defects from slight usage, such as slight scratches to bag and soles - these will be mentioned

- Good condition -merchandise is second hand, it shows signs of wear but it has been well maintained. Any defects will be mentioned and will be visible in the photos.Slight wear to material is acceptable. No holes, tears, rust, odour.

- Fair condition - second hand merchandise which has been worn frequently, and shows numerous defects, these will be mentioned and photographed.

1.2 In our Terms of Service: 
“% Commission” is the percentage of the Resale Price which Loveyoutoday charges for a Consignment Sale.

"Acceptance of Item" is where the Buyer provides Written Acceptance they intend to keep the merchandise or does not initiate a Return within the designated time period

“As-is” means the present, existing condition of the merchandise.

"Buyer" means the person who buys or agrees to buy merchandise.

“Checkout” means the secure Shopify checkout which accepts orders and take payments via numerous cards and Paypal

"Conditions" means the conditions of sale set out in this document and any special conditions agreed in writing by the Seller.

"Consignment Sale" merchandise is sold by Loveyoutoday on behalf of a private seller. All Consignment items will be clearly described as such in the product description.

“Day” means a calendar day.

“Delivery Carrier” means the company responsible for the shipment of merchandise.

"Delivery Charge” means the cost to ship merchandise.

“Designers, Brands or Manufacturers” means those companies who have designed, produced or manufactured the merchandise.

“Direct Buy ” is where Loveyoutoday agrees to purchase merchandise from a Sender at an agreed Direct Buy Price.

“Direct Buy Price” is the price agreed with the Buyer for a Direct Buy of merchandise.

“Import Duty and Customs Fees” means any payment levied on the import of merchandise.

“Initial Part Exchange Price” means the price for which a Part Exchange Service merchandise is originally advertised for sale by Loveyoutoday.

“Initial Resale Price” means the price for which Consignment Sale merchandise is originally advertised for sale by Loveyoutoday.

"Merchandise" means the physical goods subject to sale via Loveyoutoday.

“Part Exchange Price” means the price for which Part Exchange Service merchandise is currently advertised for sale by Loveyoutoday.

“Part Exchange Service” means where the Sender sends Loveyoutoday an item in exchange for merchandise listed on the Website along with any further payment required as agreed with Loveyoutoday.

“Purchase Confirmation” has the meaning as described in Section 2.4.

“Receipt of Item" means the point at which a piece of merchandise is Signed-For on delivery (this does not have to be by the named individual on the invoice).

“Resale Price” means the price for which Consignment Sale merchandise is currently advertised for sale by Loveyoutoday.

“Return” means the Buyer sending merchandise back to Loveyoutoday.

"Seller" means Loveyoutoday. 

"Sender'" means the individual sending a piece of merchandise to Loveyoutoday for resale purposes.

“Sole Marketing Agreement” means Loveyoutoday has the exclusive right to the Consignment Sale.

“Sole Marketing Agreement Period” means the 20 week period commencing from the date on which Loveyoutoday receives merchandise for a Consignment Sale.

“Website” means www.loveyoutoday.shop

“Working Day” means any day other than a Saturday, a Sunday or a day which is a public bank holiday in the United Kingdom.

“Written Acceptance” means confirmation by way of any form of electronic communication.

2. Conditions

2.1 These Terms and Conditions do not affect your statutory rights as a consumer.

2.2 Completion of the purchase and payment by the Buyer at the Checkout is deemed as conclusive evidence of full acceptance of these Terms and Conditions.

 

3.  Prices

3.1 The total purchase price, including any Delivery Charges will be displayed on the Website at Checkout. Delivery within the UK is free.

3.2 Payment must be made in full before dispatch of any goods.

 

4. Delivery

4.1 Merchandise will be shipped via a fully insured, tracked and signed for shipping service within 5 Working Days of payment being cleared, unless the Seller advises otherwise.

4.2 Loveyoutoday shall not be liable for any expenses incurred by the Buyer or any other person or company arising directly or indirectly out of any failure to meet any estimated delivery date.  Also Loveyoutoday will not be liable for any customs tax or duty.

4.3 Merchandise purchased will be shipped to the delivery address provided by the Buyer at Checkout.

 

5. Warranty and Liability

5.1 All merchandise is sold As-is and therefore no warranty is given or implied. Items sold described as in a '’New' condition or 'As New'  remain under the classification of pre-owned. Whilst merchandise may still be under manufacturer’s warranty, it is the Buyer’s responsibility to confirm any warranty period. The warranty remains with the manufacturer, not Loveyoutoday.

5.2 Loveyoutoday accepts no liability at any time for defects or issues arising after Acceptance of merchandise by the Buyer. Under no circumstances shall Loveyoutoday be liable for any indirect, incidental or consequential damage. Any personal injury related to the merchandise at any time is entirely at the Buyer’s own risk. 

5.3 Where available, original or copies of receipts will be advertised and can be requested by the Buyer, up to 14 days after Receipt of the merchandise. Any documentation advertised does not form part of the condition of sale at any time.

5.4 While every effort is made to ensure that the merchandise descriptions are accurate, the nature of the goods means that the condition can be subject to personal interpretation.

5.5 Loveyoutoday cannot guarantee the absence of odours or scents, as they are second hand items.

5.6 Due to the preloved nature of items, Loveyoutoday cannot guarantee the history of merchandise and cannot confirm whether it was previously kept in pet or smoke free environments. Under no circumstances will Loveyoutoday be liable for any injury or illness as a result of allergies arising from exposure to any Item sold. 

  

6. Customs and deliveries WORLDWIDE

6.1 All Items shipped outside of the UK will have the final purchase amount declared as contents value, as per their enclosed shipping slip.

6.2 Any Import Duty and Custom Fees due is payable by the Buyer directly to the levying country’s custom authorities. Amounts due are not the responsibility of Loveyoutoday.

6.3 For any Item returned to Loveyoutoday due to the non payment of Import Duty and Custom Fees, the Buyer will receive a refund net of Delivery Charges plus a further surcharge of £25. If re-shipping is required, the Buyer will be responsible for the shipping costs before the item is dispatched again.

 

7. Non Receipt of merchandise

7.1 In the event of non-receipt, the Buyer should inform Loveyoutoday of non-delivery within ten Days following Purchase Confirmation. After fifteen Working Days following Purchase Confirmation, if the merchandise has still failed to arrive, and the tracking details do not indicate its arrival, the Buyer will have the option for a full refund inclusive of Delivery Charges.

7.2 If the shipping/courier company have attempted to deliver the merchandise unsuccessfully, they will hold it for a period of time. If the merchandise is not collected or redelivery attempted within this time frame, the merchandise will be returned to Loveyoutoday. For any package returned to Loveyoutoday, the Buyer will receive the option of a refund net of shipping costs plus a further surcharge of £25. If re-shipping is required, the Buyer will be responsible for the shipping costs prior to shipping.

8. Ownership, Risk involved & Insurance

8.1 For Consignment Sale merchandise, ownership remains with the Sender until receipt of the merchandise has been confirmed by the Buyer.

8.2 Responsibility for merchandise outside of Loveyoutoday’s physical premises, transfers to the Shipping Carrier until Acceptance of the merchandise.

8.3 The Buyer shall inspect the merchandise upon receipt. If the merchandise is assessed to not be in the condition advertised the Buyer must contact Loveyoutoday via email at customerservice@loveyoutoday.shop within 15 days of receipt. If the Buyer fails to report any damage or defect during this period, they are deemed to have accepted the goods in the condition received and ownership of the merchandise passes to the Buyer.

8.4 Any piece of merchandise in respect of which any claim of defect or damage is made, shall be preserved by the Buyer intact together with the original packaging and accompaniments. Photographic evidence of damage or defect must be provided prior to the Buyer sending the merchandise back to the Seller.

8.5 If a Return is agreed by Loveyoutoday, the Buyer must return the merchandise, (following all written instructions set out by Loveyoutoday) for inspection within 14 days

8.6 The merchandise and accompaniments must be received by Loveyoutoday within 14 Days.

8.7 On receipt and inspection, if appropriate, a full refund exclusive of Delivery Charges incurred will be issued to the Buyer via original payment method. Return postage is at the buyer’s cost & at the buyer’s responsibility until the returned item has arrived safely with us.

 

9. Cancellation

9.1 Any cancellation instruction from the Buyer must be received by Loveyoutoday in writing via email (customerservice@loveyoutoday.shop) prior to shipping.

9.2 Cancellation described in 9.a does not result in a fee from Loveyoutoday, however payments made via Debit/credit card, Paypal, Klarna and other providers are subject to a third party processing fee of 3-4% (deducted at source) which is not refundable.  Refunds made following a cancellation will be reduced by the third party payment processing fee.  

9.3 Once merchandise has been dispatched, a cancellation of sale follows the process of a Return per Section 10.

 

10. Consignment Service & Sales

10.1 Consignment Sales are offered at the discretion of Loveyoutoday. Consignment is currently only offered in the United Kingdom, but we are working to expand this service internationally. There is no guarantee that merchandise accepted will sell at the price proposed, at a reduced price, or at all.

10.2 The Sender must email Loveyoutoday providing details of brand, model and condition together with clear photographs of the item showing serial numbers, heat stamps and signs of wear. The Sender must also advise if the merchandise comes with original dust bag, box, cards and original receipt.

10.3 Loveyoutoday will respond via email to the Sender to advise if the merchandise is accepted for Consignment. If accepted, the Sender will receive an email with an Initial Resale Price quote. This is subject to merchandise inspection when received by Loveyoutoday. The merchandise should be shipped to Loveyoutoday within 7 Days of the Initial Resale Price quote, securely protected, boxed and via an insured, trackable shipping service.

10.4 Initial Resale Prices proposed are on the basis of accurate description of the merchandise  condition, (including aroma, scratches, stains and snags) and accompaniments.

10.5 If the merchandise is not shipped within 7 Days of the Initial Resale Price quote, Loveyoutoday reserves the right to cancel the Consignment Sale for the Item.

10.6 By sending an Item to Loveyoutoday the Sender is confirming that:

          a. they are over 18 years of age.

          b. they are the owner of the Item and/or if the Item is being sold on another’s   
              behalf, the Sender has the owner’s permission to sell as if their own.

          c. the Item is not stolen or under hire / subject to any financial agreement.

          d. the Item may be lawfully sold to consumers without restriction.

          e. the Item is as-described and from a non-smoking environment.

          f. the item is authentic

          g. they accept Loveyoutoday’s Terms of Service

10.7 Loveyoutoday will email the Sender within 3 working days of receiving the merchandise with Written Acceptance confirming the proposed Resale Price. If the merchandise condition on receipt, varies from expected, then Loveyoutoday reserves the right to amend the proposed Initial Resale Price appropriately. 

10.8 The date of the email with Written Acceptance constitutes a Sole Marketing Agreement for a period of 20 weeks from that date.

10.9 If the proposed Resale Price is not acceptable to the Sender, the Sender must notify Loveyoutoday via email within 3 working days of receipt of Written Acceptance. The merchandise will be returned to the Sender by fully insured, trackable shipping. The cost of return shipping must be borne by the Sender prior to return. Loveyoutoday will not be liable for any return Delivery Charge, nor other costs incurred.

10.10 It is illegal to sell and transport counterfeit goods, so in the event that merchandise received is deemed to be non-authentic, it will be disposed of and not returned.

10.11 If a response is not received from the Sender within 3 working days of proposition of the Resale Price then Loveyoutoday assumes the Resale Price is accepted by the Sender and will proceed to market the merchandise on the Website at the Resale Price.

10.12 Loveyoutoday will endeavour to ensure merchandise is advertised for sale on the Website in 3 working days of receipt of item.

10.13 The Sender may request the return of the merchandise at any time during the Sole Marketing Agreement Period at which point the Commission Charge based on the current Resale Price plus Delivery Charge will be due, prior to the return of the Item.

10.14 Merchandise may be returned to the Sender at any time at the instigation of Loveyoutoday. If the return is instigated by Loveyoutoday prior to the end of Sole Marketing Agreement Period, the return shipping costs will be borne by Loveyoutoday. After the expiry of the Sole Marketing Agreement Period, merchandise may be returned to the Sender with the Sender being liable for shipping costs prior to the return of the Item.

10.15 Once marketed, control over the Resale Price remains with Loveyoutoday. Senders may request amendments but alterations to Resale Price are at the discretion of Loveyoutoday.

10.16 If the Item has not sold within 10 weeks from the commencement of the Sole Marketing Agreement Period,  then Sender or Loveyoutoday may suggest a price reduction or alternative marketing approach. The Sender has the right to refuse a price reduction within the Sole Marketing Agreement Period. If the Item has not sold within the Sole Marketing Agreement Period, and a price reduction is not agreed, the Item may be returned to the Sender with the Sender being liable for shipping costs prior to the return of the Item.

10.17 After the expiry of the Sole Marketing Agreement Period, if the merchandise remains unsold, any outstanding amounts owed by the Sender to Loveyoutoday must be settled prior to the merchandise being returned, inclusive of shipping costs.

10.18 When a sale is achieved and Receipt of Item has occurred, the funds will be transferred to the Sender’s nominated bank account within 5 Working Days of the merchandise being successfully delivered.  Loveyoutoday will not cover or be liable for any bank charges incurred by the Sender for a non UK GBP Bank Account.

10.19 The Sender will receive the Resale Price less the % Commission Charge, less Delivery Charges, less any payment fees deducted at source as agreed with Loveyoutoday at the outset.

10.20 Loveyoutoday % Commission Charge is discretionary based on the Resale Price, desirability and condition of the merchandise. The standard Commission Charge varies from 10%-20% plus 3% payment processing fee of the Item’s Resale Price depending on resale value.

10.21Whilst the merchandise remains the property of the Sender until confirmation of delivery to the Buyer has occurred, any photographic images or descriptions made by Loveyoutoday in relation to the merchandise remains the sole property of Loveyoutoday and cannot be assigned, reproduced or recreated for other commercial purpose.

10.22 The Terms and Conditions set out in this document shall prevail over any other communication from the Sender or Buyer if not agreed in writing by Loveyoutoday prior to Contract.

10.23 Completion of the purchase and payment by the Buyer at the Checkout is deemed as conclusive evidence of full acceptance of these Terms and Conditions.

10.24 There are no Returns for Consignment sales. All Consignment merchandise will be clearly described as such in the product description.

10.25 Any service offered by Loveyoutoday is by invitation only. Loveyoutoday retains the right to refuse any provision of services and cancel Contracts to both Senders and Buyers at its discretion. 

10.26 All Consignment items will be clearly described as such in the product description.

 

11. Part-Exchange Service

11.1 A Part Exchange Service is offered at the discretion of Loveyoutoday and may not be available during some periods throughout the year.

11.2 Initial Part Exchange Prices proposed are on the basis of full disclosure of the Item’s condition, (including aroma) and accompaniments.

11.3 The merchandise should be sent to Loveyoutoday within 4 Days of Written Acceptance, securely boxed and via an insured, trackable postal method.

11.4 By sending an Item to Loveyoutoday the Sender is confirming that:

          a. they are over 18 years of age.

          b. they are the owner of the Item and/or if the Item is being sold on another’s   
              behalf, the Sender has the owner’s permission to sell as if their own.

          c. the Item is not stolen or under hire / subject to any financial agreement.

          d. the Item may be lawfully sold to consumers without restriction.

          e. the Item is as-described 

          f. the item is authentic

          g. they accept Loveyoutoday’s Terms of Service

11.5 If the condition of the merchandise on receipt, varies from expected, then Loveyoutoday can change the Initial Part Exchange Price proposed. If the proposed Initial Part Exchange Price is not acceptable to the Sender then the Item will be returned to the Sender by fully insured, trackable shipping. Shipping costs must be borne by the Sender prior to return. Loveyoutoday will not be liable for any return shipping costs nor other costs incurred.

11.6 If a response is not received from the Sender within 3 working days of notification of the Initial Part Exchange Price, then Loveyoutoday assumes the Part Exchange Price is accepted by the Sender and will proceed to market the Item on the Website as per a Consignment Sale in accordance with Section 11 with a commission of 20 % plus 3 percent payment processing fee.

11.7 The balance of payment due (by either party) to finalise the Part-Exchange Service will be due within 3 working days of Written Acceptance. The merchandise will remain available for sale on the Website until funds have been received by Loveyoutoday.  If a Buyer or Sender wishes to secure an item in advance, it may be possible to pay a small holding deposit and this can be discussed with Loveyoutoday on a case by case basis, and payable by paypal or bank transfer.

11.8 Part Exchange Services within Mainland UK benefit from free Delivery Charges.

11.9 If the merchandise subject to a Part Exchange Service is to be returned, this is to be undertaken as per Section 10. A refund will not be provided until the Sender’s Item has been sold.

11.10 Merchandise sent as a Part Exchange Service against another Item which is subsequently returned are non-returnable to the original Sender. Any balance due to the Sender will be reduced to the Direct Buy price, per Section 13. Loveyoutoday reserves the right to return Part Exchange Service Items at their discretion and shipping costs will then be borne by Loveyoutoday.

 

12. Direct Buy Service

12.1 A Direct Buy Service is offered at the discretion of Loveyoutoday.

12.2 Direct Buy Prices proposed are on the basis of full disclosure (pics and videos including) of the Item’s condition, (including aroma, stains, scratches, snags) and accompaniments. 

12.3 The merchandise should be sent to Loveyoutoday within 5 working days of Written Acceptance, securely boxed and via an insured, trackable postal method.

12.4 By sending a piece of merchandise to Loveyoutoday the Sender is confirming that:

          a. they are over 18 years of age.

          b. they are the owner of the Item and/or if the Item is being sold on another’s   
              behalf, the Sender has the owner’s permission to sell as if their own.

          c. the Item is not stolen or under hire / subject to any financial agreement.

          d. the Item may be lawfully sold to consumers without restriction.

          e. the Item is as-described 

          f. they agree to sell the item at the proposed quoted price

          g. they accept Loveyoutoday’s Terms of Service

12.5 If the merchandise condition on receipt, varies from expected, then Loveyoutodau reserves the right to amend the proposed Direct Buy Price appropriately. If the proposed Direct Buy Price is not acceptable to the Sender then the Item will be returned to the Sender by fully insured, trackable shipping. Shipping costs must be borne by the Sender prior to return. Loveyoutoday will not be liable for any return shipping costs nor other costs incurred.

12.6 Where the direct buy quote has been provided by Loveyoutoday and the seller has agreed and sent the merchandise to Loveyoutoday, there will be an admin charge of £25 chargeable per item where the seller changes their mind and does not agree to the quoted price or range on receipt of item by Loveyoutoday.  This is subject to agreement by Loveyoutoday.  This charge will also apply where a seller has significantly misdescribed the condition of the merchandise and does not agree to a proposed price once the item has been reviewed in person.  Note this does not apply where Loveyoutoday cannot honour the original quote or range through no fault of the seller.  

12.7 If there is no response from the Sender within 3 Days of notification of the Direct Buy Price, then Loveyoutoday assumes the Direct Buy Price is accepted by the Sender and will proceed to remit to the Sender the Direct Buy Price per the agreed payment method.

12.8 All payments are sent to Senders within 48 hours of agreement of the Direct Buy Price and are provided by Bank Transfer or Paypal. This is dependent on the Sender providing their bank account or PayPal details.

 

13. Exceptional circumstances

13.1 Should Loveyoutoday be unable to ship merchandise  as a result of any cause beyond its control such as Strikes, War, Lockdowns, Illness or Injury, Epidemics, Loveyoutoday shall be relieved of its obligations and liabilities to Senders and Buyers for as long as such a situation lasts.

 

14. Dispute Resolution

14.1 At Loveyoutoday we aim to provide an exceptional service and one of our key principles is Treating Customers Fairly. If you believe we have not adhered to our Terms of Service or have any issue of complaint please email us at customerservice@loveyoutoday.shop providing us with all the details. Loveyoutoday will endeavor to resolve any disputes directly with our valued customer.
14.2 If you remain unhappy with our response, or are dissatisfied with the way your concern is handled, we recommend  contacting a consumer or advice organisation such as Consumerline or an independent consumer advice centre. We are happy to co-operate to resolve all reasonable disputes.

 

 15. Copyright Statement

15.1 You may download, display, print, post and reproduce material from Loveyoutoday in unchanged form only for your personal and non-commercial use, such as  information sharing, opinion gathering and authentication requests.

 

16. Disclaimer

16.1 Loveyoutoday is not affiliated nor is it a licensed partner of the brands sold.  All merchandise is second hand, and comes from previous owners or Sellers.

16.2 Loveyoutoday is not an authorised dealer of, nor in any way affiliated with, associated with, or endorsed by any of the Designers, Brands or Manufacturers whose products appear on the website. All product trademarks, brand names, and logos are provided for identification purposes only and remain the property of the respective trademark holder without exception.

16.3 Loveyoutoday does not claim any rights therein and is not affiliated with the owners of any non-Loveyoutoday trademarks.
